Mediation was first legally recognized as a method of dispute resolution in India under the Industrial Disputes Act of 1947. It serves as an efficient means for resolving conflicts without requiring judicial or statutory involvement. In mediation, the mediator facilitates a confidential, face-to-face session where both parties can express their perspectives and hear each other’s claims. This leads to identifying common grounds and reaching a settlement.
Mediation empowers parties to address both immediate and underlying interests, allowing flexibility to explore alternatives, evaluate options, and agree on a resolution. When both parties voluntarily agree on the terms, compliance with the settlement is higher.
Mediation in India remains a widely recognized ADR tool due to its efficiency, affordability, and flexibility, as there are no rigid proceedings or structures.
